SMTD Law’s Mike Timpane and Ed Stepans recently obtained a Final Award in favor of its general engineering contractor client who was pursuing direct claims and delay related damages on a $35M municipal composting facility. After six days of hearing, the arbitrator awarded SMTD Law’s client 201 days of compensable delay and the bulk of its direct claims. SMTD Law’s client was also declared the prevailing party, and Mike and his team then added over $500,000 of recovered attorneys’ (including in-house counsel’s), experts’, and arbitral fees plus costs to the Final Award. Even though the arbitration was held during an ongoing project, SMTD Law was able obtain some prejudgment interest as well. The client was very pleased at the result, which was a great example of SMTD Law’s collaboration with in-house counsel.
