As a surety proceeds with its investigation of a performance bond claim, you need to have a good understanding of what performance options may be available. The option that may suit a particular situation will depend on three things:
The source or origination of the performance bond claim. Information gleaned from the surety’s investigation of both the project issues and its principal’s capabilities. Finally, the terms of the bond and applicable law.
This presentation will review the typical sources of performance bond claims and the initial steps to take in an investigation. It will then survey the performance options available to sureties, and how to evaluate each option in light of the facts and circumstances presented.
Michael J. Timpane heads the firm’s Northern California office, located in Oakland, CA. He’s co-author of a reference book titled “California Fidelity and Surety Law,” CEB 1991 and has thirty years of experience representing sureties, general contractors, subcontractors and owner/developers in complex construction, commercial, real estate and business matters.
